Man charged with sexual assault

An Austin man has been arrested and charged in a sexual assault that allegedly occurred last week.

Allen Thomas Gartner, 38, was charged with three first-degree felony counts of criminal sexual conduct. He made his initial appearance in Mower County District Court Wednesday morning and is currently being held in the Mower County Jail on $250,000 unconditional bail and $100,000 with conditions.

According to court documents, Austin police officers were dispatched to a report of a sex crime around 4 a.m. July 5. The victim in the case told police she had been spending time with a friend and Gartner the night of July 4.

The victim eventually returned home, but the complaint states Gartner began messaging her on Facebook. The victim said the conversation was casual and included mentioning dating another man she had been seeing.

Police reviewed the messages and discovered that Gartner became enraged when he mentioned the incident to another man.

Gartner eventually came to the victim’s home where he allegedly began touching her inappropriately, which led to her becoming even more aggressive.

Gartner’s next hearing will be July 22.

Looking through court records, Gartner has had numerous run-ins with law enforcement, most recently in June 2019, he was convicted of possessing a stun gun and being a violent felon. For that conviction, he was sentenced to 24 months in prison.
