Fourth juror steps up, defense says – NBC Boston

Another jury in the Karen Read trial reported to their lawyers on Wednesday to say the jury had returned a not guilty verdict on two of the three charges Read faced, including murder.

Defense documents filed in Norfolk Superior Court serve as additional evidence in support of a request to Judge Beverly Cannone to dismiss two charges filed against Read in connection with the death of her boyfriend, Boston police officer John O’Keefe, during a snowstorm outside their Canton home in January 2022.

Read has been charged with second-degree murder, manslaughter while operating a motor vehicle under the influence and leaving a scene of bodily injury or death. She has pleaded not guilty and a mistrial was declared last week after a lengthy trial that drew international attention. Her team claims she was framed for the killing.

Read’s lawyers said Monday that they heard directly from one of the jurors and indirectly from two other jurors that they would find her not guilty of murder and leaving the scene. In a Wednesday filing, they said a fourth juror, identified in court documents as Juror D, reached out Monday because he felt “uncomfortable” about the end of the trial.

As prosecutors prepare to retrial Karen Read, her defense team is seeking to dismiss two of the three charges against her.

“Juror D stated that it was very disturbing that the entire case ended without the jury being asked about each count,” defense attorney Alan Jackson said in a court filing, adding that the only remaining disagreement among the jury was between the murder and lesser charges, and that they were not sure they could tell the judge they had unanimously found Read not guilty on the other two counts.

Read Karen Read’s team’s initial motion to dismiss filed after the mistrial here.

The Norfolk District Attorney’s Office previously said it was reviewing preliminary motions to dismiss counts one and three and expected a response. Their response was not filed until about noon Wednesday.

This is breaking news and will be updated.
