Families file lawsuits in Greenwood Park Mall shooting – Indianapolis News | Indiana Weather | Indiana Traffic

GREENWOOD, Ind. (WISH) — Victor Gomez’s family is suing Simon Property Group nearly two years after his shooting death at Greenwood Park Mall.

Gomez was one of three people fatally shot. Pedro Pineda, 56, and his wife, Rosa Mirian Rivera de Pineda, 37, were also killed. Two others were wounded.

In the lawsuit, the Gomez family claims the commercial real estate agency was negligent in preventing the shooting from taking place.

The family says mall employees and security guards should have monitored security cameras and seen Douglas Sapirman enter the mall with a suspicious backpack. They should also have noticed he was in a mall restroom for more than an hour before the shooting.

The lawsuit claims there were no security guards in the food court where the shooting occurred.

The complaint also stated that the presence of a security guard would have either stopped Sapirman shortly after the shooting began or would have deterred Spairman from carrying out the shooting altogether.

Mall patron Elisjsha Dicken killed Sapirman. Dicken knocked down Sapirman shortly after the shooting began.

The Gomez family is not the only one to file a lawsuit against Simon Property Group over the shooting. In January, the family of one of the non-fatal shooting victims filed a lawsuit, claiming the shooting left the victim traumatized for life.
